Terms of Service

These terms are the agreement between you and Simon Richardson, trading as Bandhamster, for using Bandhamster to build and run your band's website. By creating an account you agree to them. If you do not agree, please do not use the service.
What Bandhamster is
Bandhamster lets a band build a professional website and manage the work behind it: gigs, setlist, booking enquiries, availability and the people in the band. We give you the tools and host the result. We do not act as your agent or manager.
Your account
- You must be at least 18 and give accurate details when you sign up.
- Keep your login details safe. You are responsible for what happens under your account.
- Tell us promptly if you think someone else has access to it.
Your content stays yours
You keep ownership of everything you add: your band's name, words, images, recordings and the rest. To run the service we need your permission to host and display that content, so you grant us a licence to store, copy and show it for the purpose of operating your site and the platform. That licence ends when you remove the content or close your account, except for short-term backups that age out on their normal cycle.
What you promise about your uploads
This is the important one. When you upload anything to Bandhamster, you confirm that:
- you hold the rights to it, or have the licences you need to use it;
- you have permission from any identifiable people featured in it (bandmates, session players, anyone audible or visible in a live recording, and people in photos);
- for music, you have any rights or licences required to make the recording available, including for cover versions; and
- it does not infringe anyone else's rights and is not unlawful.
We cannot get those permissions for you, so we rely on you to have them. If content on your site breaches these promises, we can remove it. If you are featured in something on the platform and object, contact us at privacy@bandhamster.com and see our Privacy Policy.
Acceptable use
Please do not use Bandhamster to:
- break the law or infringe anyone's rights;
- upload someone else's personal data without their permission;
- post content that is harmful, abusive, misleading or designed to deceive;
- send spam, or interfere with, overload or try to break the service.
Bookings are between you and the booker
When someone enquires through your site, any conversation, agreement, gig or payment is directly between your band and that person. Bandhamster provides the tools to manage it but is not a party to it, and is not responsible for the booking, the event or any payment between you.
Plans and payment
There is a free plan, and paid plans for more features. You are billed through our payment provider for the plan you choose. Prices and any tax are shown before you pay, and you can cancel from your account at any time. We will give reasonable notice of any price change.
Availability
Bandhamster is offered as is. We work hard to keep it reliable, but we do not promise it will always be available or error-free. We may change or improve features over time.
Suspending or closing an account
You can close your account at any time. We may suspend or close an account that breaches these terms or puts the platform or other people at risk. When an account is closed we handle the data as described in our Privacy Policy.
Our responsibility to you
Some liability cannot be limited by law, and we do not try to: that includes liability for death or personal injury caused by our negligence, for fraud, and any rights you have as a consumer that cannot be excluded. Beyond that, and to the fullest extent the law allows:
- Bandhamster is a tool for building and running your site. We are not liable for your content, for any booking or event, or for anything that happens between you and a booker.
- We are not liable for indirect or unforeseeable loss, or for loss of profit, income, bookings, goodwill, opportunity or anticipated savings, or for loss of or damage to data. Please keep your own copies of anything important.
- We are not liable for problems caused by things outside our reasonable control, including outages of the third-party services we rely on, such as hosting, database or email providers.
- Our total liability to you for everything arising from the service is limited to the total amount you have paid us in the twelve months before the claim.
Your responsibility to us
If we face a claim, loss or cost because of content you uploaded, or because you broke these terms, you agree to cover what we reasonably incur. This includes a claim by a rights-holder, or by someone featured in a recording or photo you uploaded without their permission.
Changes to these terms
We may update these terms as the service grows. We will update the date at the top, and flag significant changes. Continuing to use Bandhamster after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute.
